El artículo que a continuación se presenta tiene como objeto un acercamiento a dos casos criminales seguidos por el sistema punitivo de la época colonial a indios en la cordillera de Mérida. En el mismo se tratará de analizar los elementos relacionados al castigo y las penas dentro del marco del sistema punitivo del antiguo régimen, donde el fin último no era reformar al culpable, sino de servir de ejemplo a la comunidad indígena de aquél momento. Un segundo caso se refiere a la obediencia en el marco de los referentes mentales y construcción de la relación de servicio y poder entre padres de familia y los indígenas. La metodología de investigación parte de los sumarios criminales como fuentes de primera mano, complementándose con las diferentes conceptualizaciones en torno al delito y las penas derivadas de la época donde se estudian los casos.

Resumen en otro Idioma | The article is an approaching to two criminal cases followed by the punitive system of the colonial time to several Indians in the chain of mountains of Mérida city. We will try to analyze the related elements to the punishment and the pains within the frame of the punitive system of the old regime, where the primordial aim was not to reform the guilty, but to serve as example to the indigenous community of those moments. A second case talks about the obedience within the framework of mental referents and the epistemological construction around the relationship of power and services between family’s parents and the Latin American natives. The methodology of research begins with the criminal summaries, as sources of first hand, complementing themselves with different definitions over the crime and the pains derived from the time in which the cases were studied. |
