El objetivo de este trabajo es determinar bajo que condiciones legales en el derecho chileno un diseño industrial, amparado por la Ley de Propiedad Industrial, puede recibir una protección acumulada conferida por la Ley de Derechos de Autor. En este sentido, el legislador chileno, siguiendo el modelo regulatario del derecho italiano, estableció que una obra de arte aplicada será protegible por el derecho de autor solamente si su valor artístico puede ser considerado con separación del carácter industrial del objeto al cual se encuentra incorporada. De esta manera, el presente estudio se centra en precisar la exigencia de separabilidad, acudiendo para ello a los desarrollos doctrinarios italianos y estadounidenses, que por su riqueza nos permitirán postular nuestra postura acerca del requisito de separabilidad en el derecho chileno.

Resumen en otro Idioma | The objective of this article is to determine under what legal conditions in the Chilean law an industrial design, protected by the Industrial Property Law, can receive an accumulated protection awarded by the Copyright Law. In this sense, Chilean legislator, following the regulating model of Italian Law, established that a work of art applied will be protected by Copyright Law only if its artistic value can be considered with separation of the industrial carácter of the object which it is found incorporated. The present study is centered to precise the demand of separation, responding for it to the Italian and American doctrine developments, that by their wealth will let us to postulate our position about the requirement of separation in the Chilean Law. |
