Abstract
El presente trabajo analiza una forma de argumentación utilizada por
la Corte Interamericana de Derechos Humanos que podría llamarse
“razonamiento probabilístico”. Esta forma de argumentación ha sido
previamente identificada por otros autores (aunque no ha recibido una
denominación específica). La novedad de este artículo no está en describir
esta institución, sino en analizar su naturaleza y hacer un estudio sistemático
de la misma. Entre otras cosas, este artículo se refiere a la forma en que
opera este razonamiento en relación a la carga de la prueba y al estándar
probatorio. Al hacerlo, este artículo propone ciertas consideraciones que
deben tenerse en cuenta al aplicar este razonamiento.

| Resumen en otro Idioma | This paper analyzes a kind of argumentation used by the Inter-American Court, which could be called “probabilistic reasoning.” This kind of reasoning has been previously identified by other scholars (even though it has not been given a particular name). The novelty of this paper does not lie on the description of this concept, but in the analysis of its nature and the systematic analysis of it. Among other things, this article refers to the way how this reasoning operates in relation to the burden and standard of proof. When doing so, this manuscript gives some suggestions that the Court should bear in mind when applying this kind of reasoning. |
