El presente artículo científi co pretende contrastar la juridicidad del gravamen impositivo del Impuesto Sobre la Renta (ISLR) sobre 2 ingresos patrimoniales de
los administrados (Indemnizaciones por Daños y Perjuicios y Nacionalizaciones) con el valor jurídico de la justicia tributaria del artículo 316 constitucional, pues
califi camos como moralmente censurable la omitiva juridifi cación contable de esos dos conceptos económicos en la LISLR del Año 2014, vía artículo 14. Para tales
efectos, hemos partido de un principio, como la efectividad del pago efectuado en la materialización del perjuicio causado, en virtud de que tales conceptos
devengados suponen una garantía patrimonial resarcitoria ante el sufrimiento de lesiones en la esfera jurídica cualquiera de los administrados, que no pueden
sufrir menguas administrativas de ningún tipo.

Resumen en otro Idioma | The present scientifi c article intends to contrast the juridicity of the income tax levy (ISLR) over 2 patrimonial income of the administered ones (State Compensation for Damages and Nationalizations) with the legal value of the tax equity contained in the constitutional rule 316 of the Bolivarian Republic of Venezuela, because we believe that the ominative accounting legality of such economic concepts in the Income Tax Law of the Year 2014, is morally reprehensible. For these purposes, we have adopted a juridical principle such as the effectiveness of the government payment carried out by the State in the materialization of the damage caused, since such accrued monetary concepts represent a compensatory equity guarantee against the suffering of injuries to the subjective legal sphere of the administered ones that do not may suffer administratives and tributary wages of any kind. |
