El propósito del trabajo es, por una parte, poner en evidencia la necesidad de superar las posturas iuspositivistas y fundar el Derecho sobre principios racionales, universales y necesarios, y por la otra, examinar los fundamentos racionales ético-jurídicos de la metafísica kantiana, los cuales, según su autor, son conceptos a priori que pertenecen a la estructura racional originaria del sujeto humano y como tal no sólo sirven de estructura al orden moral y jurídico, sino que además le imprimen a éste su necesaria legitimidad.

Resumen en otro Idioma | The purpose of this paper is, on the one hand, to make evident the need to surmount juspositivist postures and base Law on rational, universal and essential principles, and, on the other hand, examine the ethical-legal rational bases of Kantian metaphysics. According to the author, these are a priori concepts that pertain to the original rational structure of the human being and as such, they serve not only as a structure for the moral and legal order, but also give it its necessary legitimacy. |
