La Ley del Estatuto de la Función Pública incorporó un título dedicado a los contratados en la Administración Pública. La Ley no les niega la condición de personas a su servicio, pero sí excluye la posibilidad de ingresar por vía de contrato a la función pública, situación que resultaba distinta durante la vigencia de la Ley de Carrera Administrativa, cuando se utilizaba el contrato para defraudar a las modalidades de ingreso previstas, lo que trajo como
consecuencia que la doctrina jurisprudencial estableciera el criterio de los funcionarios de hecho. Con la constitucionalización del concurso como
único medio de ingreso a la carrera administrativa y con la Ley del Estatuto, se modificó el criterio Jurisprudencial, estableciéndose que no pueden órganos administrativos ni jurisdiccionales, otorgar a funcionarios que sean designados o presten servicios como funcionarios de hecho o contratados, la cualidad de funcionarios de carrera.

Resumen en otro Idioma | The Law of the Civil Service Statute has incorporated a title dedicated to the contracting parties in the Public Administration. Law does not deny them the condition of persons to its service, but it excludes the possibility of entering by means of a contract to the civil service. That fact was different during the legal effect of the Administrative Career Law, when the contract was used in order to defraud the established formalities for entering, a thing which brought as a consequence that the doctrine of jurisprudence established the criterion of the officers in fact. Having been incorporated the contest into the constitution as a unique means for entering to the administrative career and with the Law of Statute, it was modified the criterion in jurisprudence, which established that administrative authorities or court authorities should not be allowed to grant the officers that are designated or render services as officers in fact or that are contracted, the quality of being career civil servants. |
