Este estudo tem por objetivo demonstrar que a patente de medicamentos não tem como único
objetivo a remuneração do inventor ou titular ela tem que não só atender a função social, assim
como toda propriedade (art 5º, inc XXII e XXIII da CRFB/88) como também deve contribuir para
o desenvolvimento tecnológico e econômico do país (art 5º, inc XXIX e art 1º da Lei 9.279/96), ou
seja, a propriedade industrial tem que estar a disposição da sociedade, o titular tem a obrigação de
dar um destino adequado a sua propriedade, caso contrário poderá sofrer restrições no exercício
dos seus direitos.

Resumen en otro Idioma | This study aims to demonstrate that a drug patent´s objective is not only to remunerate the inventor or patent holder. Besides fulfilling its social function, patent of medicines must attend all property (article 5, XXII and XXIII, CRFB/88) but also contribute to the technological and economic development of the country (article 5, XXIX, CRFB/88 and article 1, Law 9.279/96), i.e. industrial property must be available to society, and holders are obliged to give a suitable destination for their properties, otherwise they may face restrictions in the exercise of their rights. |
