En Venezuela el mundo de la franquicia se presenta en ascenso. Bajo esta
estrategia empresarial las empresas cerveceras han modificado la distribución
de sus productos, pasando de un distribuidor independiente a un distribuidor
bajo franquicia, al cual se le adjudica el falso rol de empresario. Desde esta
perspectiva, el trabajo pretende analizar la franquicia en las empresas cerveceras
y relación Laboral encubierta, con el propósito de conocer los contratos con las
franquicias, el contrato mercantil, así como, franquicia y relaciones encubiertas.
Para tal fin, se realizo una investigación teórica, la metodología consistió en
una revisión de fuentes secundarias. Los resultados reflejan que la franquicia
en el sector cervecero concreta un sistema de comercialización de productos
y servicios. Por este motivo, se dirige a mejorar el funcionamiento de la venta,
distribución y comercialización dentro de un mercado para desarrollar cadenas de
distribución. Se concluye, que la franquicia se presenta como una alternativa de
empresa flexible y adaptable a los constantes cambios del mercado. El contrato
para franquicia se enmarca en una visión comercial, con la cual se conduce
a encubrir las relaciones laborales erradicando de sus normativas el Derecho
del Trabajo como norte para la contratación o negociación de fuerza laboral.

Resumen en otro Idioma | In Venezuela, the world of franchising is presented on the rise. Under this business strategy brewers have changed the distribution of its products, through an independent distributor to a franchised dealer, which is awarded the false role of entrepreneur. From this perspective, the paper analyzes the franchise in the breweries and disguised employment relationship, in order to meet contracts with franchisees, the commercial contract, as well as franchise and covert relationships. To this end, we made a theoretical investigation, the methodology involved a review of secondary sources. The results show that the franchise in the brewing industry specific marketing system products and services. For this reason, it aims to improve the functioning of the sale, distribution and marketing in a market to develop supply chains. We conclude that the franchise is presented as an alternative flexible and adaptable company to constantly changing market. The franchise contract is part of a business vision with which leads to cover labor relations eradicating its labor law regulations and north to the contracting or negotiating labor force. |
