La negativa o el rechazo voluntario de los pacientes hacer transfundido por convicciones o creencias religiosas, es sin duda alguna una de las situaciones más difíciles y complejas de resolver en la práctica médica diaria, desde lo ético-legal. Se pretende establecer si el acto médico es lícito y cuál debe ser la actitud de los médicos en Venezuela ante la negativa de transfusión de sangre en situaciones extrema que atente contra su vida en los pacientes Testigos Jehová. En la investigación también se analiza si en el ordenamiento jurídico venezolano si existen disposiciones ético/legales vigentes con la temática planteada. Es un estudio observacional prospectivo, de tipo transversal mediante la utilización de una encuesta anónima, aleatoria, estandarizada y normatizada con preguntas abiertas y cerradas. Se encuestaron 200 médicos de instituciones dispensadoras de salud públicas y/o privadas de la ciudad de Maracaibo-Zulia Venezuela. El 92,8 % desconocían los fundamentos legales, éticos o religioso, mientras que el 100% no tenía conocimiento de las disposiciones ético/legales vigentes en el ordenamiento jurídico venezolano. La transfusión en contra de la voluntad, es un acto de ponderación entre el derecho a la vida y a la libertad religiosa, por lo que acto médico y la actitud del médico es lícita, ya que dicha acción está amparada por preceptos constitucionales, así como éticos morales.

Resumen en otro Idioma | The refusal or the voluntary refusal of patients to be transfused by religious convictions or beliefs, is undoubtedly one of the most difficult and complex situations to solve in daily medical practice, from the ethical-legal point of view. It is intended to establish if the medical act is lawful and what should be the attitude of doctors in Venezuela before the refusal of blood transfusion in extreme situations that threatens their lives in Jehovah's Witness patients. The investigation also examines whether in the Venezuelan legal system there are ethical / legal provisions in force with the subject matter. It is a prospective, cross-sectional observational study using an anonymous, randomized, standardized and standardized survey with open and closed questions. 200 doctors from public and / or private health dispensing institutions of the city of Maracaibo-Zulia Venezuela were surveyed. 92.8% did not know the legal, ethical or religious foundations, while 100% did not have knowledge of the ethical / legal provisions in force in the Venezuelan legal system. The transfusion against the will, is an act of weighting between the right to life and religious freedom, so that medical act and the attitude of the doctor is lawful, since such action is protected by constitutional precepts, as well as ethical morals. |
