Resumen en otro Idioma | Dr. Mihály Ficsor, as Chairman of the Hungarian Copyright Council, wrote an article published by UNESCO in 2003 entitled “Collective Management of Copyright and Related Rights at a triple crossroads: Should it remain voluntary or could it be “scaled up” or made mandatory? This question remains unanswered in most Latin American legislation. The collective management of the author’s patrimonial right continues to be voluntary, based on the exercise of the exclusive right that the author has over his work and, in a few countries, the collective management of the right to remuneration or simple remuneration is mandatory; However, in the present investigation we propose to determine if the Latin American states are complying with their obligations assumed in the declarations and pacts on human rights through voluntary collective management or, if, on the contrary, they are in legislative debt before the new windows of exploitation of works protected by copyright. |
