Hasta ahora los intereses supraindividuales ha sido tratado desde posiciones ajenas al Derecho romano y a la tradición romanista; en virtud de que, dadas sus particulares características, se ha entendido que estas nuevas realidades sociales, no pueden ser satisfechas desde una postura romanista y por ende "individualista" del Derecho. En consecuencia, se ha dejado sentir en el seno de nuestros ordenamientos jurídicos la necesidad, impulsada por el fenómeno de la globalización y la apertura socioeconómica, de modificar o crear instituciones jurídicas mediante la incorporación de conceptos e instituciones que pertenecen a un sistema jurídico distinto al Civil Law, especialmente aquellos del Common Law, cuyas ventajas parecieran arropar la tradición romanística de nuestros propios ordenamientos jurídicos. Pese a estas consideraciones, este artículo presenta algunos lineamientos útiles para encaminar la búsqueda de posibles antecedentes en Roma de los intereses supraindividuales.

Resumen en otro Idioma | Until now, supraindividual interests have been treated from a position other than that of Roman law and Roman tradition. Given their particular characteristics, it is understood that the new social reality cannot be satisfied from a Romanists posture and therefore, "individualistic" law. Consequently, in the heart of our juridical classification the need, propelled by the globalization phenomena and socioeconomic opening of modifying or creating juridical institutions different from Civil Law, especially those which Common Law whose advantages seem to cover traditional Romanesque of our own juridical systematization is no longer felt. Despite these considerations, this article presents some useful guidelines to direct the search for possible forebears of the supraindividual interests in Rome. |
