dc.description.abstractDurante la vigencia de la Constitución Nacional de 1961 (CN), la legislación ambiental venezolana estaba representada, principalmente, por la Ley de Reforma Agraria (1960) y la Ley Orgánica del Ambiente (1976). En este contexto, el Tribunal de Primera Instancia Agraria del Estado Mérida (30 de mayo de 1989) amparó el derecho a un medio ambiente adecuado, mediante la tutela del derecho a la salud de los habitantes de la cuenca del río Mucujún. El objetivo de este artículo es valorar esta trascendental jurisprudencia, precedente fundamental tanto del reconocimiento del derecho a disfrutar de un medio ambiente seguro, sano y ecológicamente equilibrado, así como de su tutela efectiva (Constitución de la República Bolivariana de Venezuela, artículos 127 y 26 respectivamente).es_VE

dc.description.abstract1While the national constitution (NC) of 1961 was in force, Venezuelan environmental legislation was represented, mainly, by the Agrarian Reform Law (1960) and the Organic Environmental Law (1976). In this context, the Agrarian Court of Mérida State (30 May 1989) upheld the right to an appropriate environment through the protection of the right to health of the inhabitants of the Mucujún River basin. This article aims to evaluate the importance of this far-reaching law, a fundamental precedent for recognition of the right to enjoy a safe, healthy and ecologically balanced environment as well as effective protection, foreseen in the Constitution of the Bolivarian Republic of Venezuela (Articles 127 and 26, respectively)es_VE
