El propósito del presente artículo, sin pretender hacer un tratado sobre lo ético y lo jurídico, es analizar estos efectos junto a la situación actual de los aspectos legales, que tiene todo ser humano, sobre el derecho a que se le reconozca la posibilidad de disponer de su propia vida en situaciones especiales simplemente por la dignidad. Derecho basado en el principio de la autonomía, es decir, en la sujeción de sí mismo, siempre que pueda expresar su voluntad en uso de su discernimiento. Para nadie es un secreto ni se puede, ni vale la pena ocultar que, pese al juramento hipocrático y al código de deontología médica, desde siempre, los médicos han participado en la toma de decisiones sobre el fin de la vida y actualmente es común suspender o no instaurar tratamientos en determinados casos, aunque ello conlleve a la muerte del paciente en situación de enfermedad terminal. Es lo que se conoce como limitación del esfuerzo terapéutico, limitación de tratamiento, o simplemente, la muerte digna u ortotanasia. Aunque no hay un derecho a morir, debemos reconocer que todo ser viviente incluyendo al humano, tiene derecho a una muerte digna: a morir con dignidad, a extinguirse como corresponde a su condición de ser humano racional y libre. En Venezuela la muerte digna u ortotanasia es aceptada siempre y cuando se haya certificado la muerte cerebral y se cuente con la autorización de los familiares.

Resumen en otro Idioma | The purpose of this article, without trying to make a treaty on the ethical and legal, is to analyze these effects together with the current status of the legal aspects, which every human being, on the right to be recognized that the possibility of his own life in special situations just for dignity. Law based on the principle of autonomy, namely in securing itself if it can express its will to use their discernment. It is no secret, nor can, not worth hiding that despite the Hippocratic oath and the code of medical ethics has always been involved in medical decisions concerning the end of life and is now common suspend or establish treatments in certain cases, although this may lead to patient death in terminally ill situation. It is what is known as a limitation of therapeutic effort, limiting treatment, or simply, a dignified death or orthothanasia. Although there is no right to die, we must recognize that all living things, including humans, have the right to a dignified death: to die with dignity, to die as befits their status as free and rational human being. In Venezuela orthothanasia worthy or death is accepted as long as has been certified as brain dead and with the authorization of the family. |
