Abstract

Ante el abandono de la Comunidad Andina por Venezuela en 2008 el sistema sui generis de Indicaciones Geográficas que ofrecía su Decisión 486 deja de ser norma aplicable en este país, retornando al régimen de la Ley de Propiedad Industrial de 1955 que no contiene normas particulares en la materia, salvo una prohibición expresa de registro como marca de cualquier indicación geográfica, además de lo que en este sentido refiere el Convenio de la Unión de París para la protección de la Propiedad Industrial y el ADPIC situación que hace necesario analizar las normas del marco legal vigente a septiembre de 2018 que pudiesen ser aplicables en caso de que se decidiera ofrecer protección y registro a estos signos distintivos.

Resumen en otro Idioma	Thanks to Venezuela’s withdrawal of the Andean Community in 2008, the sui generis system of Geographical Indications offered by its Decision 486 is no longer applicable in this country, returning to the regime of the 1956 Industrial Property Law that does not contain any particular rule about it with the exception of an express prohibition on registration as a trademark of any geographical indication in addition to what the Paris Union Convention for the Protection of Industrial Property and the TRIPS Agreement refers to in this respect, situation that makes it necessary to analyze t he current legal framework until September 2018, which could be applicable if it were decided to offer protection and registration to these distinctive signs.
