| dc.description.abstract | El presente artículo tiene como objetivo analizar los presupuestos procesales como
requisitos para la existencia y validez del proceso, donde se precisa que la demanda
y la pretensión se sustancien y decidan en cumplimiento de garantías, principios y
derechos de orden constitucional y legal. Asimismo, el control judicial existente en
el proceso civil venezolano que permita evitar la arbitrariedad judicial. Por ello,
se realizaron consideraciones previas sobre aspectos fundamentales de los
presupuestos procesales, su control judicial y los efectos que produce la ausencia

requirements for the existence and validity of the process, where it is specified
that the demand and the claim are substantiated and decided in compliance with
guarantees, principles and rights of constitutional and legal order. Likewise, the
existing judicial control in the Venezuelan civil process that allows to avoid
judicial arbitrariness. For this reason, preliminary considerations were made on
fundamental aspects of the procedural budgets, their judicial control and the
