El autor analiza la «distintividad adquirida» en el Derecho Comunitario Andino, por ser una institución novedosa en el sistema de Propiedad Intelectual comunitario. Mediante la «Distintividad adquirida» un signo que no reúne los méritos para su protección como marca, puede acceder a ella si se demuestra su uso y la distintividad adquirida por dicho uso. En el trabajo se analizan los principales cambios tanto en la legislación andina como en las diferentes decisiones del Tribunal de Justicia de la Comunidad Andina en relación con el tema. Se explican cuáles son las causales prohibitivas de registro que pueden ser superadas. Son analizados los requisitos de procedencia que las autoridades deben considerar para determinar si un signo
puede ser protegida bajo la excepción de la «distintividad adquirida». Finalmente presentan algunos aspectos críticos que deberían ser considerados en una posible reforma del «Régimen Común sobre Propiedad Industrial» de la Comunidad Andina.

Resumen en otro Idioma | The author analyzes the «acquired distinctiveness» (Secondary meaning) in the Andean Community. This is a new institution in the Community Intellectual Property system. Through «secondary meaning», a sign that does not meet the requirements for protection as a trademark, can be protected if the applicant proves the distinctiveness acquired by the sign by its use. In this work it is analyzed the main changes in the Andean legislation and in different decisions from the Court of Justice of the Andean Community in relation with this matter. It is analyzed the grounds for refusal of registration that can be surpassed by the «secondary meaning» exception. It is also studied the requirements that the authorities must consider to determine if a sign can be protected under the exception of the «Secondary meaning «. Finally, some significant aspects that would have to be considered in a possible reform of the «Common Regime on Industrial Property» of the Andean Community. |
